The Northland Hometown Hero Contest

Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT IMPROVE ONE'S CHANCES OF WINNING.

This is a Two-Part Promotion, consisting of (i) a contest (the “Contest”) awarding a prize (the “Grand Prize”) to up to 19 winners (each a “Grand Prize Winner”) and (ii) a random-draw sweepstakes (the “Sweepstakes”) (collectively, the Contest and Sweepstakes are referred to herein as the “Promotion”). The Promotion is named The Northland Hometown Hero Contest and will take place from June 1, 2014 to July 20, 2014. The intent of the Contest is to allow participants to nominate a person who has made a positive impact in his/her community by submitting an essay, describing the nominee they would like to nominate as a “Hometown Hero”. Each nomination must clearly depict the “Hometown Hero” theme, in a poignant, relevant manner. The Contest will include a round of judging and a round of public voting to determine nineteen (19) Grand Prize Winners of a Grand Prize, one in each of Northland Communications Corporation’s nineteen (19) participating service areas, all as further described herein. The Sweepstakes is a random drawing made from eligible Sweepstakes Entries (the “Sweepstakes Winner”) entitling the Sweepstakes Winner to a prize (the “Sweepstakes Prize”), all as further described herein.

TIMING: The Northland Hometown Hero Contest (the “Promotion”) is presented by Northland Communications Corporation (the “Sponsor”) and administered by US Sweepstakes & Fulfillment Co. (the “Administrator”). The Promotion begins at 12:00:01 AM Pacific Time (“PT”) on Sunday, June 1, 2014 and ends at 11:59:59 PM PT on Sunday, July 20, 2014 (the “Promotion Period”) and consists of three (3) periods: the Nomination Period, Judging & Finalist Determination Period and Public Voting Period as represented in the chart below. The Sponsor’s computer is the official timekeeping device for this Promotion.

Nominator & Voter Eligibility: Individuals who submit a nomination (the “Nominators”) and individuals who submit a vote (the “Voters”) must be legal residents of the 50 United States or D.C. and 18 years of age or older. Void outside the United States and wherever else prohibited by law. Nominators cannot nominate themselves as a Nominee.

Employees of the Sponsor, Administrator and each of their respective subsidiaries, affiliates, advertising and promotion agencies (collectively, “Promotion Entities”), and the immediate family members of, and/or those living in the same household of each, are not eligible to nominate, be nominated, vote or win. Promotion is subject to all applicable federal, state and local laws and regulations. Participation in the Promotion constitutes participant’s full and unconditional agreement to and acceptance of the terms and conditions described herein ("Official Rules").

HOW TO SUBMIT A NOMINATION & ENTER THE SWEEPSTAKES: During the Nomination Period, Nominators can submit a nomination by completing an online or paper nomination form in its entirety using one of the methods below, including your full name, full address, email address and phone number and the full name, full address, email address and phone number of the person you are nominating (the “Nominee”), and providing a short essay (the “Essay”), not to exceed 500 words, explaining why the Nominee should be a Hometown Hero (the “Nomination”).

There are three (3) ways to submit a nomination:

Method #1/Online: Visit www.GetNorthland.com/hero (the “Contest Web Site”), you will be prompted to verify your email address via email or via Facebook Connect as described below (the “Email Verification”).

  • If you choose to verify your email address via email, you will be requested to enter your email address and an email will be sent to your submitted email address. You must follow the link as instructed in the email in order to complete the Email Verification. Then, follow the instructions on email verification confirmation screen to return to the Contest Website to complete the nomination form.
  • If you choose to verify your email address via Facebook Connect, you will be required to login to Facebook and authorize the Contest application. Upon completing the authorization, you will be returned to the Contest Website to complete the nomination form.
    • Once email verification is complete, complete the nomination form in its entirety and submit (the “Online Nomination”).

      Method #2/Facebook: Visit www.facebook.com/NorthlandComm, click on the Contest Tab, click “Like” to become a fan of the Northland Communications page, complete the nomination form in its entirety and submit (the “Facebook Nomination”).

      Method #3/Mail-In: Visit a participating Northland Communications office to get a paper nomination form, complete the nomination form in its entirety, and mail it to: Attn: Hometown Hero Contest, Northland Communications, PO Box 961, Corsicana, TX 75110 (the Mail-In Nomination”). Each Mail-In Nomination must be mailed separately and must be received by Monday, June 30, 2014.

      Method #4/Northland Office: Visit a participating Northland Communications office to get a paper nomination form, complete the nomination form in its entirety, and return it to a participating Northland Communications office (the “Northland Office Nomination”). Northland Office Nominations must be received by close of business day on Monday, June 30, 2014.

      All Nominations must be received between 12:00:01 AM PT on Sunday, June 1, 2014 and 11:59:59 PM PT on Monday, June 30, 2014 (the “Nomination Period”). Incomplete Nominations will not be accepted and are void. Photocopied, illegible, or mechanically reproduced Nominations are not eligible. Nominations will not be returned or acknowledged by the Sponsor. Sponsor is not responsible for lost, late, damaged, misdirected or postage-due mailed Nominations.

      Nominators will receive one (1) Sweepstakes Entry for each eligible Nomination received during the Nomination Period.

      Limit: There is a limit of three (3) Nominations and three (3) Sweepstakes Entries per person per email address during the Nomination Period, regardless of whether Nominator has more than one email address.

      All of the terms and conditions as described herein apply to the format of the Nomination. By submitting a Nomination, the Nominator understands and grants to the Sponsor permission for his/her Nomination and other Nominator information to be posted on the Sponsor’s Website and Facebook throughout the world for viewing by visitors to these Websites and used in accordance with the Official Rules. Sponsor reserves the right to post sample Essays it has created in connection with the Promotion on the Sponsor’s Website and Facebook.

      Multiple Nominators are not permitted to share the same email address. Any attempt by any Nominator to submit more than the stated number of Nominations by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that Nominator’s Nominations and Sweepstakes Entries and that Nominator will be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. In the event of a dispute as to any Nomination, the authorized account holder of the email address used to submit a Nomination will be deemed to be the Nominator. The “authorized account holder” is the natural person assigned an email address by an Internet access provider, online service provider or other organization responsible for assigning email addresses for the domain associated with the submitted address. Nominator may be required to provide Sponsor with proof to Sponsor’s satisfaction that such party is the authorized account holder of the email address associated with the entry.

      All Nominations must comply with the following minimum guidelines to be eligible:

      • Nominee must be an eligible individual as specified in the Eligibility Section of these Official Rules.
      • Essay cannot contain content that is irrelevant to the purpose of the Contest.
      • Essay cannot be profane, pornographic, sexually explicit or suggestive or contain nudity.
      • Essay cannot be violent or promote firearms/weapons.
      • Essay cannot promote alcohol, illegal drugs or tobacco.
      • Essay cannot defame, misrepresent or contain disparaging remarks about people, brands, products or companies.
      • Essay cannot be obscene or offensive, endorse any form of hate or hate group or be derogatory to any ethic, racial, gender, religious, professional or age group.
      • Essay cannot reference or contain materials embodying copyrighted images, names, likenesses or other indicia identifying any brand, products, company or person, living or dead, without permission.
      • Essay cannot communicate messages or images inconsistent with the positive images and/or goodwill to which Sponsor and Facebook wish to associate.
      • Essay cannot depict illegal activity and cannot itself be in violation of any law.
      • Essay cannot in any way reference persons or organizations without written permission from any person or organization whose name or likeness is used.

      Sponsor reserves the right in its sole and absolute discretion to reject, disqualify and/or remove any Nominations that violate these Official Rules without any notification or warning.

      By submitting a Nomination, Nominator (or parent/legal guardian if potential Nominator is deemed a minor in his/her state of residence) warrants, represents and agrees that: (a) it is the Nominator’s original work and has been legally created; (b) it has not been previously published or distributed in any media; (c) it has not been entered in or won previous contests or awards; (d) it does not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other legal or moral rights of any person or entity; (e) that the Nominator has obtained written permission from the Nominee (or parent/legal guardian if potential Nominee is deemed a minor in his/her state of residence). The Nominator and Nominee (collectively the “Participants”) must transfer all rights for usage to the Sponsor if and as requested; (f) Nominator owns all rights title and interests in the Nomination, including without limitation, any copyrights, and has full authority to transfer all such rights to Sponsor; (g) publication of the Nomination and Essay via various media, including but not limited to posting on the Sponsor’s Website and Facebook, will not infringe on any third-party rights; and (h) Participants shall indemnify and hold harmless the Sponsor, Facebook, Administrator and related entities, agents and assigns from any claims and damages (including reasonable attorneys' fees) arising from or relating to such Participant’s acts, omissions or the breach or alleged breach of its representations and warranties herein, the Nomination, or such Participant’s conduct relating to the Nomination, the acceptance or use of any prize or otherwise in connection with this Promotion. Sponsor reserves the right to remove, reject or disqualify (along with the Nominators who submitted them) any Nomination which, in its opinion or the opinion of the Administrator, violates any of these Official Rules or is otherwise inappropriate.

      By submitting a Nomination, Nominator warrants and represents that he/she and any Nominee appearing or who are otherwise identifiable in the Nomination consents to the submission and the use of the Nomination. By participating, Nominator grants Sponsor permission to use his/her name, Essay, hometown, photograph or image for future advertising and publicity purposes in any and all media without additional compensation, notification or permission. By submitting a Nomination, Nominator grants Sponsor the right to edit, adapt, and publish any or all Nominations and to use these Nominations in any media form or in any manner without attribution or further compensation. NOMINATIONS ARE THE VIEWS/OPINIONS OF THE INdivIDUAL NOMINATOR AND DO NOT REFLECT THE VIEWS OF SPONSOR IN ANY MANNER.

      Nominations made by any other individual or entity that is not the person named on the submitted Nomination or made in any manner inconsistent with these Official Rules will be declared invalid and disqualified from this Promotion.

      NOMINEE ACCEPTANCE: All qualifying Nominees will be contacted by the Sponsor by email or phone and requested to accept his/her Nomination and entry into the Contest by signing and returning an Affidavit of Eligibility & Publicity/Liability Release (the “Affidavit”) within three (3) days of notification (the “Accepted Nomination”). If a Nominee is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the Nominee’s parent or legal guardian will be required to execute and return the Affidavit on minor’s behalf. Noncompliance will result in disqualification of the Nominee and disqualification of the Nominator’s corresponding Sweepstakes Entry.

      JUDGING & FINALIST DETERMINATION: All Accepted Nominations received during the Nomination Period will be divided into nineteen (19) communities in which the Nominees reside (the “Hometowns”), as depicted in the chart below, and as determined by the Sponsor.

      All Accepted Nominations will be judged by a panel of judges, as determined by the Sponsor. Judging will begin on/around Monday, July 1, 2014 and be completed on/around Sunday, July 6, 2014 (the “Judging & Finalist Determination Period”) based on the following judging criteria:

      a) Nominee’s contribution to the community (50%)

      b) Nominee’s impact on the community (25%)

      c) Originality (25%)

      The three (3) Accepted Nominations, for each of the nineteen (19) Hometowns, which receive the highest total scores based on the judging criteria will be deemed the finalists and advance to the Public Voting Period (each a “Finalist”). In the unlikely event of a tie, the tied Nomination with the highest score in Criterion A, Nominee’s contribution to the community, will be deemed the potential Finalist. If additional tie breakers are needed, the tie-breaking mechanism above will be used; however, instead of the highest score in Criterion A determining the potential Finalists from among the tied entries, the highest scores in each of Criteria B through C, in sequence (to the extent needed) will determine the potential Finalists. In the event additional tiebreakers are needed, all tied Nominations will be judged by a separate panel of judges using the judging criteria above.

      PUBLIC VOTING: Beginning Monday, July 7, 2014 at 12:00:01 AM PT and ending on Sunday, July 20, 2014 at 11:59:59 PM PT (“Public Voting Period”), the three (3) Finalists for each Hometown will be posted to the Contest Gallery on the Contest Website. During the Public Voting Period, individuals who are legal residents of the 50 United States including the District of Columbia and who are 18 years of age or older may access the Contest Gallery and cast three (3) votes per day for the Finalist that he or she believes is the most deserving of the title Hometown Hero. Promotion Entities are not eligible to vote.

      The first time a Voter visits the Contest Website, the Voter will be required to complete the Email Verification to verify his/her email address. To vote, visit www.GetNorthland.com/hero, complete the registration form, including your name, email address and mailing address and choose a Hometown from the drop down menu to view that Hometown’s Contest Gallery. Upon deciding which Finalist you believe is the most deserving of the title Hometown Hero, click the "Vote" button associated with that Finalist and follow all instructions to submit your vote (the “Vote”).

      Each Voter will receive one (1) Sweepstakes Entry for each qualifying and verified Vote.

      Limit: There is a limit of three (3) Votes and three (3) Sweepstakes Entries per person per email address per day during the Public Voting Phase. A Nominee and Nominator may vote for his/her own Nomination.

      Any attempt to gain Votes by promising a benefit to the Voter or any other person, including sites such as Vote Exchange or other similar social media sites, may subject the Nominator, Nominee and Voter to disqualification in the sole discretion of the Sponsor. Voters, Nominees or Nominators who spam for the purpose of casting Votes and earning Sweepstakes Entries may have their Votes and Sweepstakes Entries disqualified and their submissions may be voided. Decisions of the Sponsor are final relating to all aspects of the online voting process and results. The Sponsor may disqualify any Nomination or Vote if Nominee, Nominator, Voter or related parties violate any of the terms and conditions of the Promotion or these Official Rules.

      Sweepstakes Entries/Votes become sole property of Sponsor and none will be acknowledged or returned. Nothing in these Official Rules shall obligate Sponsor to publish or otherwise disclose any Nomination or Vote submitted in connection with this Promotion. Nominators, Nominees and Voters agree to be bound by the terms of these Official Rules and by the decisions of Sponsor, which are final and binding on all matters pertaining to this Promotion.

      CONTEST WINNER DETERMINATION: The nineteen (19) Finalists, one (1) from each Hometown, who receive the most Votes during the Public Voting Phase for his/her Hometown will be deemed a potential Grand Prize winner. In the event of a tie, the Administrator will review the tied Finalists based on the following criteria: a) Nominee’s contribution to the community (50%), b) Nominee’s impact on the community (25%) and c) Originality (25%) to determine the winner.

      SWEEPSTAKES RANDOM DRAWING: One (1) Sweepstakes Prize winner will be selected in a random drawing from among all eligible Sweepstakes Entries received during the Nomination Period and Public Voting Period by the Administrator on or about Wednesday, July 23, 2014.

      PRIZES/APPROXIMATE RETAIL VALUE (“ARV”):

      Contest Grand Prizes: The Grand Prize shall consist of $250. Nineteen (19) Grand Prize winners will each receive $250. In addition, Sponsor will donate $500 to a local charity of the Sponsor’s choice, in each Grand Prize winner’s Home Town. The ARV of each Grand prize is $250.

      Sweepstakes Prize: The Sweepstakes Prize shall consist of $250. One (1) Sweepstakes winner will receive $250. The ARV of the Sweepstakes Prize is $250.

      The total ARV of all prizes to be awarded: $5,000.

      PRIZE NOTIFICATION & ACCEPTANCE: Grand Prize winners will be notified via email and/or phone, and will be required to sign and return, within seven (7) days of notification, the Affidavit. Noncompliance will result in disqualification and an alternate Finalist with the next highest score will be notified. The Grand Prize will be awarded within approximately 45 days after the Grand Prize Winner is verified.

      Sweepstakes Prize winner will not be notified. The Sweepstakes Prize will be awarded within approximately 45 days after the winner is selected.

      If a winner is otherwise eligible under these Official Rules, but is nevertheless deemed a minor in his or her state of primary residence, the prize will be awarded in the name of winner's parent or legal guardian who will be required to execute and return the Affidavit on minor’s behalf. If the Affidavit is returned as undeliverable or if the selected winner cannot accept or receive the prize for any reason, or he/she is not in compliance with these Official Rules, the prize will be forfeited and an alternate winner may be selected.

      Non-winning Finalists will not be notified. If winner notification is returned as undeliverable or if the selected potential winner cannot accept or receive the prize for any reason or she is not in compliance with these Official Rules, this may result in disqualification and the next highest scoring Finalist may be notified and be deemed the winner, if qualified.

      PRIZE CONDITIONS: Prizes are non-assignable or transferable. No substitution is permitted except if prize is unavailable, in which case a prize of equal or greater value will be awarded. No exchange or substitution of prizes, except at the sole discretion of the Sponsor. Any other incidental expenses on prize not specified herein are the winner’s sole responsibility.

      Winner is responsible for all federal, state, local, income and any other taxes associated with winning prize.

      Any winner’s Sweepstakes Entry and/or Nomination Acceptance and acceptance of a prize awarded constitutes permission for the Sponsor to use the winner’s name, image, photograph, likeness, statements, biographical information, voice and address (city and state) commercially or non-commercially, in all forms of media known or unknown, in perpetuity, worldwide, without notice or further compensation, except where prohibited.

      By accepting a Grand Prize or Sweepstakes Prize, each of the Grand Prize winners and Sweepstakes winner further agree to release the Sponsor, from any and all liability, loss or damage of any kind arising out of or in connection with winners' participation in this Promotion or with respect to the awarding, receipt, possession, use and/or misuse of any prize.

      No confidential relationship is established by any Nominator, Nominee or Voter and the Sponsor as a result of participating in the Promotion. None of the information submitted by the Nominator, Nominee or Voter will be treated as trade secrets, confidential information or as protected data.

      GENERAL: In the event any Nominator, Nominee, Voter or winner engages or has engaged in behavior that (as determined by Sponsor in Sponsor's sole discretion) is obnoxious or threatening, illegal or that tends to annoy, abuse, threaten, disparage or harass any other person or company including the Sponsor, the Sponsor reserves the right to disqualify the Nominee, Nominator, Voter or winner and void any Nominations, Votes or Sweepstakes Entries of said person.

      Incomplete, corrupted or untimely Nominations, Nomination Acceptance or Votes, or any Nominations or Votes generated by a script, macro or other automated means are void and will be disqualified. Sponsor and its agencies are not responsible for incomplete, corrupted or untimely Nominations or Votes or for incomplete, lost, interrupted or unavailable network, server or other connections, miscommunications, computer or software malfunctions or telephone transmission problems or technical failures, garbled transmissions, damage to a user’s computer equipment (software or hardware) or other errors or malfunctions of any kind whether human, mechanical, electronic or otherwise. Proof of submitting a Nomination, Nomination Acceptance or Vote will not be deemed to be proof of receipt by Sponsor. Sponsor, Facebook, their affiliate companies, parents, subsidiaries, officers, directors and agents are not responsible for any incorrect or inaccurate information, including, without limitation, that caused by Website users or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error which may occur in the processing of Nominations, Nomination Acceptance or Votes in the Promotion. Sponsor assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Nominations, Nomination Acceptance or Votes.

      If, for any reason, the Promotion is not capable of being conducted as planned, including but not limited to infection by computer viruses, bugs, tampering, unauthorized intervention, fraud, technical failures or other causes whether or not beyond the control of Sponsor, Sponsor reserves the right at its sole discretion to cancel, terminate, modify or suspend the Promotion. Sponsor is not responsible if the Promotion cannot be implemented or prize cannot be awarded due to delays or interruptions due to acts of God, acts of war, strikes, governmental action, natural disasters, weather or acts of terrorism. Sponsor also reserves the right in its sole discretion to disqualify any individual found to be violating these Official Rules or suspected of attempting to disrupt or defraud the Nomination or Vote process or the operation of the Promotion. Sponsor reserves the right to disqualify any Nominator, Nominee or Voter at any time during the Promotion Period that may be found ineligible.

      By participating in the Promotion, Nominators, Nominees and Voters agree to be bound by these Official Rules, including all eligibility requirements, and agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Promotion. Failure to comply with these Official Rules may result in disqualification.
